1. NATURE AND PURPOSE OF THE ASSESSMENT
The Growth Works Business Health Check is a diagnostic assessment tool designed to assist organisations in understanding their current operating state, structural alignment, and potential areas of risk or opportunity.
The Assessment:
Is informational and diagnostic only
Reflects the organisation’s self-reported inputs at a point in time
Is intended to support strategic awareness and future planning
It does not constitute financial advice, legal advice, operational advice, investment advice, or any form of professional assurance.
2. NO ADVICE / NO RELIANCE
The Assessment does not provide advice.
To the maximum extent permitted by law:
Growth Works does not warrant the accuracy, completeness, or applicability of the results
The Assessment must not be relied upon as the sole basis for any decision
No representation is made that outcomes will be achieved by acting on the results
All decisions, actions, implementations, or omissions arising from the Assessment are undertaken entirely at the organisation’s own risk.
3. CLIENT RESPONSIBILITY & ASSUMPTION OF RISKELIANCE
By accessing or using the Assessment, the organisation acknowledges and agrees that:
It is solely responsible for:
Verifying information
Seeking independent professional advice
Assessing suitability before acting
It assumes full responsibility for all:
Strategic decisions
Financial commitments
Operational changes
Risk exposures
Growth Works accepts no responsibility for outcomes resulting from:
Misinterpretation
Partial use
Failure to act
Delay in action
External market, regulatory, or economic changes
4. LIMITATION OF LIABILITYIANCE
To the fullest extent permitted by applicable law:
Growth Works’ total aggregate liability is strictly limited to the amount paid for access to the Assessment
Growth Works shall not be liable for:
Indirect or consequential loss
Loss of profit, revenue, opportunity, goodwill, or reputation
Business interruption or third-party claims
This limitation applies regardless of whether liability arises in contract, tort, negligence, equity, statute, or otherwise.
5. NO GUARANTEES OR WARRANTIES
Growth Works makes no guarantees, express or implied, including but not limited to:
Business performance
Financial outcomes
Risk reduction
Compliance sufficiency
Operational resilience
Growth or profitability
Past results, methodologies, or enterprise use cases do not guarantee future outcomes.
6. STRATEGY CALL DISCLAIMER
Any Strategy Call offered or undertaken:
Is interpretive and exploratory only
Does not constitute advice
Does not create an advisory, fiduciary, or agency relationship
Does not replace independent professional advice
No obligation exists to proceed beyond the Strategy Call.
7. INTELLECTUAL PROPERTY & USE RESTRICTIONS
All content, frameworks, logic, scoring models, and materials remain the exclusive intellectual property of Growth Works Consulting & Advisory.
The Assessment:
Is licensed for internal organisational use only.
Must not be:
Shared
Reproduced
Resold
Reverse-engineered
Distributed to third parties
Unauthorised use may result in legal action.
8. CONFIDENTIALITY & DATA HANDLING
Growth Works does not claim ownership of client-entered data.
Clients are responsible for:
Secure storage
Internal access controls
Data governance compliance
Growth Works is not responsible for:
Data loss
Breach arising from client systems
Third-party platform vulnerabilities
9. JURISDICTION & GOVERNING LAW
This agreement is governed by the laws applicable to the client’s principal place of business, subject to
mandatory local consumer protections where applicable.
Nothing in these Terms excludes rights that cannot be excluded under law.
10. ACCEPTANCE & BINDING AGREEMENT
Growth Works does not claim ownership of client-entered data.

Accessing the Assessment
Downloading the workbook
Checking the acceptance box
The client confirms that:
They have read and understood these Terms
They accept them in full
They are authorised to bind the organisation
