Applies To: All live, virtual, and hybrid events operated, hosted, or promoted by Growth Works Consulting & Advisory

1. Purpose and Legal Position

This Policy is designed to:
Protect the legal, financial, and reputational interests of Growth Works Advisory
Provide clear, fair, and transparent terms for event participants.
Comply with applicable consumer protection and contract laws, including:
Australian Consumer Law (ACL),
UK Consumer Rights Act,
US Federal & State consumer protections,
EU Consumer Rights Directive,
Establish a consistent, enforceable framework for refunds, rescheduling, cancellations, and force majeure events.
Registration for any event constitutes acceptance of this Policy.

2. Trust Rights to Modify, Reschedule, or Cancel Events

The Trust reserves the absolute right, at its sole discretion, to:
Cancel an event.
Reschedule an event (date, time, venue, or format);
Convert an event from in-person to virtual (or vice versa).
Modify speakers, content, agenda, duration, or delivery format;
Limit, postpone, or withdraw incentives, giveaways, or prizes.

This may occur due to, but is not limited to:
Force majeure events.
Venue unavailability.
Speaker illness or withdrawal.
Safety, security, or risk concerns.
Regulatory, legal, or compliance requirements.
Insufficient registrations.
Circumstances beyond the Trust’s reasonable control.

3. Force Majeure

The Trust shall not be liable for failure or delay in performance where such failure results from events beyond reasonable control, including but not limited to:
Natural disasters.
Pandemics or public health orders.
Government restrictions or travel bans.
Civil unrest, terrorism, or threats to safety.
Power, network, or infrastructure failures.
Acts of God or similar unforeseeable events.
In such cases, refund obligations may be limited as outlined below.

4. Refund Policy – Trust-Initiated Changes

4.1 Event Cancellation by the Trust

If the Trust cancels an event entirely and does not offer a rescheduled or alternative event:
Attendees may be eligible for a refund of registration fees paid (excluding third-party fees where applicable), or
credit or transfer to a future Trust event of equal or greater value.
The Trust determines the remedy offered, subject to applicable consumer law.

4.2 Event Rescheduling or Format Change

f an event is rescheduled or materially altered:
Registrations will automatically transfer to the new event date or format; and
If an attendee is unable to attend the rescheduled event, they may request:
A credit toward a future event, or
A partial or full refund at the Trust’s discretion, taking into account costs already incurred.
5. Refund Policy – Attendee-Initiated Cancellations

5.1 Change-of-Mind
Except where required by law:
Change-of-mind refunds are not guaranteed.
Refund eligibility (if any) depends on:
Notice period before the event.
Event type (live, virtual, premium, or incentive-based);
Non-recoverable costs already incurred.

5.2 Non-Attendance
Failure to attend an event (including late arrival, early departure, or technical access issues on the attendee’s side) does not entitle the attendee to a refund.

6. Incentives, Giveaways, and Prizes
All incentives, giveaways, and financial prizes are offered at the Trust’s discretion.
The Trust may:
Substitute prizes with items of equal or greater value.
Withdraw incentives due to compliance, eligibility, or risk concerns.
Disqualify participants who breach event rules or act in bad faith.
Prizes are non-transferable and non-redeemable for cash unless expressly stated.

7. Limitation of Liability
To the fullest extent permitted by law:
The Trust’s liability is limited to the amount paid for event registration.
The Trust is not liable for:
Travel, accommodation, or ancillary costs.
Loss of income, opportunity, or business interruption.
Consequential or indirect losses.
Nothing in this Policy excludes non-excludable consumer guarantees.

8. Dispute Resolution Process
In the event of a dispute:
The attendee must submit a written complaint to the Trust within 14 days of the event issue.
The Trust will acknowledge the complaint within 7 business days.
The Trust will seek to resolve the matter in good faith within 30 days.
If unresolved, the parties agree to attempt mediation before commencing legal proceedings, where permitted by law.
Jurisdiction and governing law are determined as outlined below.

9. Governing Law and Jurisdiction
This Policy is governed by the laws of Victoria, Australia.
Where international attendees are involved, mandatory local consumer protections may apply.
Any legal proceedings shall be brought in the courts of Victoria, unless otherwise required by law.

10. Policy Updates
The Trust reserves the right to amend this Policy at any time.
The version published on the Trust’s website at the time of registration shall apply.
