EVENT PARTICIPATION, GIVEAWAYS & INCENTIVES POLICY
Applies To:
All live events, webinars, workshops, summits, digital events, in-person events, promotional campaigns, competitions, giveaways,
referral incentives, and loyalty programs conducted by Growth Works Consulting & Advisory (“Growth Works”, “we”, “our”, “us”).
1. PURPOSE
This Policy governs participation in all Growth Works events and promotional incentive programs. It establishes eligibility, behavioural expectations, prize conditions, liability limitations, and dispute mechanisms.
Participation in any Growth Works event or incentive program constitutes acceptance of:
– Terms of Service
– Client Conduct, Defamation & Engagement Integrity Policy
– Privacy Policy
– Defamation Pre-Action Protocol
– No Class Actions / No Coordinated Complaints Policy
2. EVENT PARTICIPATION TERMS
2.1 Eligibility
Participants must:
. Be 18 years or older (unless expressly stated otherwise).
. Provide accurate and complete registration information.
. Not be suspended, banned, or under investigation for prior misconduct.
Growth Works reserves the right to refuse, revoke, or suspend participation at its sole discretion where conduct risks reputational, operational, or legal harm.
2.2 Code of Conduct
Participants must:
. Act respectfully toward hosts, speakers, staff, and other attendees.
. Refrain from harassment, intimidation, defamation, or disruptive behaviour.
. Not record, reproduce, distribute, or commercially exploit event content without written consent.
. Not attempt to reverse engineer proprietary frameworks, materials, or intellectual property.
Immediate removal may occur without refund if conduct breaches this clause.
2.3 Recording & Media Consent
By attending any Growth Works event (virtual or physical), participants acknowledge:
. Events may be recorded.
. Their name, image, voice, or likeness may appear in recordings.
. Growth Works may use such recordings for marketing, training, or commercial purposes without compensation.
Participants may opt out in writing prior to the event.
3. GIVEAWAYS, COMPETITIONS & PROMOTIONAL INCENTIVES
3.1 No Guarantee of Prize
All giveaways and incentives are:
. Subject to availability.
. Not guaranteed unless expressly confirmed in writing.
. Provided at Growth Works’ sole discretion.
Where prizes are limited in number, allocation will be determined via transparent criteria or random selection.
3.2 Compliance With Law
Growth Works will comply with applicable:
. Australian Consumer Law (Competition and Consumer Act 2010)
. State-based trade promotion regulations (if applicable)
. US FTC promotional guidelines (if applicable)
. EU Unfair Commercial Practices Directive (if applicable)
Where permits are required, they will be obtained as necessary.
3.3 Prize Conditions
Unless otherwise stated:
. Prizes are non-transferable.
. No cash alternatives are offered.
. Expiry dates may apply.
Travel, accommodation, or tax liabilities are the winner’s responsibility.
If a winner fails to respond within 7 days, the prize may be reallocated.
3.4 Incentive Misuse & Fraud
Growth Works reserves the right to:
. Disqualify any participant suspected of manipulation, fraudulent entries, or coordinated exploitation.
. Withhold or cancel incentives where abuse is detected.
. Seek indemnification for losses arising from fraudulent conduct.
Automated entries, bot submissions, or coordinated complaint pressure campaigns result in permanent disqualification.
4. REFERRAL & AFFILIATE INCENTIVES
Where referral incentives apply:
. Referrals must be genuine.
. Self-referrals are prohibited.
. Artificial traffic or fabricated registrations void eligibility.
. Commissions (if any) are paid only after verified revenue is received.
Growth Works may audit referral sources at its discretion.
5. LIABILITY LIMITATIONS
To the maximum extent permitted by law:
. Growth Works is not liable for technical failures, platform outages, or internet disruptions.
. Growth Works is not responsible for third-party venue failures.
. Liability for any claim is limited to the event registration fee paid (if any).
Nothing in this policy excludes rights under Australian Consumer Law where liability cannot be excluded.
6. CYBERSECURITY & PLATFORM RISKS
Participants acknowledge:
. Online events may involve third-party platforms.
. Growth Works does not guarantee immunity from cyber incidents beyond reasonable safeguards.
. Participants are responsible for securing their own devices and internet connections.
No liability arises from external platform vulnerabilities outside Growth Works’ control.
7. NO PUBLIC DISPUTES DURING ACTIVE EVENT
Participants agree that:
. Any complaint must be raised privately via official channels.
. Public reviews, social media posts, or coordinated complaints during an active dispute may constitute breach of contract.
All disputes are subject to mandatory mediation prior to litigation.
8. DISQUALIFICATION & REMOVAL RIGHTS
Growth Works may:
. Remove participants without notice.
. Cancel prizes.
. Refuse future participation.
. Issue formal legal notice under the Defamation Pre-Action Protocol where required.
This right may be exercised without refund where misconduct is established.
9. TAX & FINANCIAL RESPONSIBILITY
Winners are solely responsible for:
. Income tax reporting.
. GST or VAT obligations.
. Any regulatory disclosure requirements in their jurisdiction.
Growth Works provides no financial or tax advice in relation to incentives.
10. INTELLECTUAL PROPERTY
All event materials, frameworks, methodologies, slide decks, recordings, and proprietary systems remain the intellectual property of Growth Works.
Reproduction, distribution, or derivative use without written permission is strictly prohibited.
11. FORCE MAJEURE
Growth Works is not liable for cancellation, delay, or alteration of events due to:
. Natural disasters
. Government restrictions
. Cyber incidents
. Speaker unavailability
. Public health emergencies
Rescheduling or credit issuance will be determined at Growth Works’ discretion.
12. GOVERNING LAW & JURISDICTION
For Australian participants:
Governing law is the State of Victoria, Australia.
For US participants:
Disputes are subject to binding arbitration under AAA rules.
For EU participants:
Local consumer rights remain preserved, subject to mediation prior to court proceedings.
International participants agree to private dispute resolution prior to litigation.
13. POLICY AMENDMENT
Growth Works reserves the right to amend this Policy at any time.
Updates take effect upon publication.
